Thank you for visiting WallPanelWarehouse.com and purchasing products from us. The following Terms & Conditions, along with our Privacy Policy, Shipping Policy, Return Policy, and Damages & Installed Product Policy, govern your purchase (collectively, the "Terms"). By purchasing products from WallPanelWarehouse.com ("Website"), you agree to be bound by these Terms and represent that you have the right, authority, and capacity to enter into this agreement, including the Dispute Resolution — Mandatory Arbitration and Class Action Waiver provision below.


1. Eligibility / COPPA

Individuals under the age of 18 are not eligible to make purchases on our Website. By using, visiting, browsing, or making a purchase, you certify that you are at least 18 years old.

If you are using the Website or making a purchase on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms. In that case, "you" and "your" refer to both you individually and that entity.

We are committed to protecting the privacy of children. The Website is not designed or intended for individuals under 18, and we do not knowingly collect personal information from visitors under 18. If you are a parent or guardian and believe your child has provided us with personal information, please contact us and we will take steps to remove it from our records.


2. Definitions

"Wall Panel Warehouse," "we," "our," or "us" means Wall Panel Warehouse and each of its owners, subsidiaries, affiliates, partners, officers, employees, contractors and subcontractors, vendors, fulfillment and carrier partners, insurers, successors, agents, and assignees.

"Products" means wall panels, samples, trim, accessories, and any other products sold by Wall Panel Warehouse on the Website.

"Order Confirmation" means the receipt for your purchase emailed to you describing the products, quantities, and price.

"You" or "your" means the individual who initiates, facilitates, or completes the transaction for the purchase of Products on the Website, and anyone acting on their behalf.


3. Order Measurements & Quantities

You are solely responsible for determining the quantity of Products needed for your project, including accounting for waste, cuts, and trimmings based on your room dimensions and panel layout. We recommend purchasing all panels needed for your project in a single order to ensure dye lot and color consistency. We are not responsible for color differences between separate orders.


4. Pricing & Payment

All prices are listed in U.S. dollars. We reserve the right to correct pricing errors at any time. If a pricing error is discovered after you place an order, we will notify you and give you the opportunity to confirm or cancel your order at the correct price. We accept major credit cards and other payment methods as displayed at checkout. By submitting your payment information, you authorize us to charge the full order amount.

California residents: Sales tax will be collected where required by California law.


5. Shipping

Our full shipping terms are available at WallPanelWarehouse.com/policies/shipping-policy and are incorporated herein by reference. Key terms include:

Free shipping on samples applies to standard parcel delivery. Flat-rate shipping applies to orders of 1–7 boxes based on quantity. Orders of 8 or more boxes receive free curbside LTL freight delivery. Free shipping applies to customers in the contiguous United States only. Customers in Alaska, Hawaii, U.S. territories, or outside the contiguous U.S. may be subject to additional charges.

For LTL freight shipments, tracking will be sent within 1–2 business days of shipment. Once tracking is issued, the shipment cannot be stopped or rerouted. You will have 48 hours to accept delivery once the shipment reaches the destination terminal, after which storage fees may accrue.

Orders shipping to limited access locations (gated communities, schools, churches, construction sites, etc.) may incur additional charges. Please contact us before ordering if this applies.


6. Order Cancellation

If you need to cancel an order, contact us immediately. Orders cannot be canceled once they have been processed for shipment. We reserve the right to cancel any order at our sole discretion, including in cases of suspected fraud, pricing errors, or product unavailability. If we cancel your order, you will receive a full refund via your original payment method.


7. Returns

Our full return policy is available at WallPanelWarehouse.com/policies/refund-policy and is incorporated herein by reference. Key terms include:

You must contact us within 14 days of receiving your order to initiate a return. Returns are accepted on orders of 4 or more boxes only. All boxes must be factory sealed, unopened, and undamaged. A Return Authorization Number will be issued and must accompany the return shipment. You are responsible for all return shipping costs. Returns sent Cash-on-Delivery (COD) will not be accepted.

All returns are subject to a 30% restocking fee. Original shipping costs will be deducted from your refund even if your order received free shipping.

Installed products cannot be returned or exchanged for any reason. Trim and accessories are non-returnable and non-refundable. Special or custom orders are not eligible for return.

Refunds will be issued via the original payment method within 4 weeks of our receipt and inspection of the returned products.


8. Damages & Installed Product Policy

Our full damages and installed product policy is available at WallPanelWarehouse.com/pages/damages-installed-product-policy and is incorporated herein by reference. Key terms include:

You must inspect all products upon delivery and note any damage on the driver's Proof of Delivery before signing. Damage must be reported to us within 3 days of delivery with photo documentation. Do not write "Subject to Inspection" on the delivery receipt.

Keep all damaged materials until we confirm they may be disposed of. Installing products with visible defects constitutes acceptance, and no claim will be considered after installation.


9. Missing Orders

Missing orders must be reported to us within 24 hours of carrier confirmation of delivery. If you believe your order is missing, first verify the tracking information and check with all members of your household and neighbors. We will file a Missing Package Report with the carrier on your behalf. Wall Panel Warehouse is not responsible for replacing or refunding orders that the carrier confirms were delivered to the correct address. Any remaining missing item claims must be submitted within 10 days of delivery confirmation.


10. Claims & Inspection

You are solely responsible for inspecting all products for visible damage or defects prior to installation. All claims must be submitted within 10 days of receipt of products. Failure to inspect or notify us within this period will be deemed acceptance of the products and waiver of any defect claim. No claims will be considered for products that have been installed.


11. Warranty & Disclaimer of Warranties

While we strive for accuracy on our Website, product images, descriptions, colors, and specifications are for reference only. Actual product appearance may vary due to photography, monitor settings, dye lot variation, and other factors. Products that vary slightly from Website imagery are not considered defective.

Manufacturer warranties, if any, are passed through to you. You must contact the manufacturer directly for warranty claims. EXCEPT AS SET FORTH ABOVE, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WALL PANEL WAREHOUSE DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ALL PRODUCTS ARE PROVIDED "AS IS."

California residents: To the extent California law provides you with rights that cannot be waived by contract, those rights are not affected by this disclaimer.


12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOUR SOLE AND EXCLUSIVE REMEDY AGAINST WALL PANEL WAREHOUSE FOR ANY CLAIM ARISING OUT OF OR RELATED TO PRODUCTS PURCHASED, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, OR OTHERWISE, SHALL BE REPLACEMENT OF THE PRODUCTS OR A REFUND NOT TO EXCEED THE PURCHASE PRICE OF THE PRODUCTS ON YOUR ORDER CONFIRMATION.

IN NO EVENT SHALL WALL PANEL WAREHOUSE BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOSS OF USE, OR COSTS OF INSTALLATION OR REMOVAL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IF ANY PORTION OF THIS LIMITATION IS FOUND INVALID OR UNENFORCEABLE, THE AGGREGATE LIABILITY OF WALL PANEL WAREHOUSE SHALL NOT EXCEED THE PURCHASE PRICE OF THE PRODUCTS ON YOUR ORDER PLUS ONE HUNDRED DOLLARS ($100).

California residents: Nothing in this section limits liability for fraud, gross negligence, or willful misconduct, or any rights you may have under the California Consumer Legal Remedies Act (CLRA), California Civil Code § 1750 et seq., or other non-waivable California consumer protection statutes.


13. Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Wall Panel Warehouse and its owners, affiliates, officers, employees, contractors, vendors, carriers, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your breach of these Terms; (b) your use of the Website or purchase of Products; (c) your violation of any applicable law or third-party right; or (d) inaccurate information you provide to us.


14. California Consumer Rights

If you are a California resident, you have specific rights under the California Consumer Legal Remedies Act (Civil Code § 1750 et seq.), the California Unfair Competition Law (Business & Professions Code § 17200 et seq.), and other applicable laws. Nothing in these Terms waives any rights you have under applicable California or federal consumer protection law that cannot be waived by contract.

15. California Privacy Rights (CCPA)

If you are a California resident, you have rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), including the right to know what personal information we collect, the right to request deletion of your personal information, the right to opt out of the sale or sharing of your personal information, and the right to non-discrimination for exercising these rights. 16. Product Recalls

If we become aware that a product you have purchased is subject to a Consumer Product Safety Commission (CPSC) recall, we will notify you at the email address provided at the time of purchase and/or post notice on our Website. You may also visit www.cpsc.gov or call the CPSC 24-hour Toll-Free Consumer Hotline at 1-800-638-2772.


17. Intellectual Property

All content on the Website, including text, images, graphics, logos, and product descriptions, is the property of Wall Panel Warehouse or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any Website content without our prior written consent.


18. Governing Law

These Terms and any dispute arising out of or related to your purchase of Products or use of the Website shall be governed by and construed under the laws of the State of California and the United States of America, without regard to California's conflict of law principles, except as otherwise required by the Federal Arbitration Act.


19. Dispute Resolution — Mandatory Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Informal Resolution. Before initiating arbitration, you agree to first contact us and attempt to resolve any dispute informally. Most concerns can be resolved quickly by contacting our customer service team.

Binding Arbitration. If informal resolution fails, any claim, dispute, or controversy arising out of or relating to these Terms, the Website, or your purchase of Products (a "Claim") shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except as otherwise provided herein. The AAA's rules are available at www.adr.org. The arbitrator shall apply California substantive law consistent with the Federal Arbitration Act, 9 U.S.C. § 1 et seq.

Class Action Waiver. ALL CLAIMS MUST BE ARBITRATED ON AN INDIVIDUAL BASIS ONLY. YOU EXPRESSLY WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE ACTION WITH RESPECT TO ANY CLAIM. IF THIS CLASS ACTION WAIVER IS FOUND UNENFORCEABLE FOR ANY CLAIM, THEN THE ARBITRATION AGREEMENT WILL NOT APPLY TO THAT CLAIM, AND THAT CLAIM MUST BE BROUGHT IN COURT.

Exceptions. The following Claims are excluded from arbitration: (a) claims that qualify for small claims court; (b) claims seeking injunctive or other equitable relief related to intellectual property infringement; and (c) any Claim where applicable law prohibits arbitration.

Location. Any in-person arbitration hearing shall take place in the county in which you reside in California, or another mutually agreed location.

Fees. Arbitration fees will be governed by the AAA's Consumer Arbitration Rules. We will pay arbitration filing fees for Claims under $10,000 where you are the claimant, unless the arbitrator finds your Claim frivolous.

Time Limit. ANY CLAIM MUST BE SUBMITTED WITHIN TWELVE (12) MONTHS OF THE DATE ON WHICH THE CLAIM AROSE, OR IT WILL BE PERMANENTLY BARRED.


20. Assignment

You may not assign or transfer these Terms or any rights hereunder without our prior written consent. We may freely assign these Terms to any successor or affiliated entity without notice.


21. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, Return Policy, and Damages & Installed Product Policy, constitute the entire agreement between you and Wall Panel Warehouse with respect to your purchase of Products and use of the Website, and supersede all prior agreements or understandings.


22. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.


23. Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of our right to enforce that provision in the future.


24. Accessibility

If you have a disability and are unable to access these Terms on our Website, please contact us and we will make reasonable efforts to provide the content in an accessible format.
